What TennisPal Does
TennisPal is a tennis match, swing, workout, and progress tracking app. The app may help you record tennis sessions, view performance summaries, review trends, and better understand how your game changes over time.
TennisPal is intended for personal information, tracking, and fitness reference purposes only. Features may vary by device, operating system version, subscription status, and app version.
Health and Fitness Disclaimer
TennisPal is not a medical device and does not provide medical advice, diagnosis, treatment, or professional coaching advice. Information shown in the app, including motion, workout, swing, match, calorie, heart rate, or performance information, is for general fitness and informational purposes only.
You are responsible for deciding whether you are healthy enough to participate in tennis, exercise, or other physical activity. Always consult a physician or qualified health professional before beginning or changing any exercise program, especially if you have a medical condition, injury, or health concern.
Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, faintness, or any other concerning symptoms.
Eligibility
By using TennisPal, you represent that you are legally able to enter into these Terms and that your use of the app is permitted under applicable law. If you use TennisPal on behalf of another person or entity, you are responsible for ensuring that you have authority to do so.
Your Data and Local Storage
TennisPal may store certain app data locally on your device, including profile settings, tennis sessions, workout records, swing information, preferences, and other app-related information. Local data may be lost if you delete the app, erase your device, or remove app data.
You are responsible for maintaining your own device, backups, Apple ID, iCloud settings, and any system-level permissions used with the app.
Subscriptions and Paid Features
TennisPal may offer subscriptions, paid features, premium access, or other in-app purchases. Paid features may unlock enhanced tracking, history, analysis, summaries, or other app functionality described in the app at the time of purchase.
All purchases are handled through Apple’s App Store and are subject to Apple’s payment terms and policies. We do not directly process your payment card information.
Annual Free Trial
TennisPal may offer an annual subscription with a free trial period when displayed in the app or on the App Store purchase sheet. The exact trial length, price, subscription period, and renewal terms are shown before you confirm your purchase.
Unless you cancel before the trial ends, the subscription will automatically convert to a paid annual subscription and your Apple ID will be charged according to the terms shown at purchase.
Auto-Renewable Subscription Terms
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period, unless you cancel in time.
You can manage or cancel subscriptions in your Apple ID account settings. Deleting the app does not cancel an active subscription. Refund requests and billing issues are handled by Apple according to Apple’s policies.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless canceled at least 24 hours before the current period ends.
- You may manage or cancel subscriptions through your Apple ID account settings.
- Any unused portion of a free trial may be forfeited when you purchase a subscription, where applicable.
Changes to Paid Features
We may add, modify, limit, or remove paid features over time. If a change materially affects an active paid subscription, we will handle the change in accordance with applicable law and App Store policies.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use TennisPal on Apple-branded devices that you own or control, as permitted by Apple’s App Store terms and applicable law.
User Content
You may enter, create, upload, or store content in TennisPal, such as profile information, notes, photos, match details, and session records. You remain responsible for the content you provide and for ensuring that you have the rights and permissions needed to use it in the app.
You should not enter or upload content that is unlawful, harmful, misleading, infringing, or violates the rights of others.
Acceptable Use
You agree not to misuse TennisPal or interfere with its normal operation. You may not attempt to reverse engineer, copy, modify, distribute, sell, rent, or exploit the app except as permitted by law or these Terms.
- Do not use TennisPal for unlawful, harmful, or deceptive purposes.
- Do not attempt unauthorized access to any systems, services, or data.
- Do not disrupt, damage, or overload the app or related services.
- Do not use TennisPal in a way that infringes intellectual property, privacy, or other rights.
Intellectual Property
TennisPal, including its name, logos, design, visuals, interface, software, text, and other materials, is owned by the TennisPal developer or applicable rights holders and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
Third-Party Services
TennisPal may rely on or interact with third-party platforms and services, including Apple services such as the App Store, Apple Watch, HealthKit, iCloud, and system frameworks. Your use of those services may be subject to separate terms, privacy policies, and permissions controlled by the third party.
Privacy
Your use of TennisPal is also governed by our Privacy Policy. Please review the Privacy Policy to understand how information may be processed, stored, and controlled.
No Warranty
TennisPal is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. We do not warrant that the app will be uninterrupted, error-free, accurate, complete, secure, or suitable for your particular needs.
Performance metrics and summaries may be estimates and may vary depending on device sensors, permissions, settings, movement, environment, and other factors.
Limitation of Liability
To the maximum extent permitted by law, the TennisPal developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of or inability to use TennisPal.
Nothing in these Terms limits liability where it cannot be limited under applicable law.
Termination
We may suspend or terminate your access to TennisPal if you violate these Terms, misuse the app, or if we discontinue the app or any feature. You may stop using TennisPal at any time. Certain sections of these Terms will continue to apply after termination where their nature requires it.
Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the Last Updated date. Your continued use of TennisPal after changes become effective means you accept the updated Terms.
Governing Law
These Terms are governed by the laws applicable in the developer’s place of residence or business, without regard to conflict of law principles, unless a different law is required by your local consumer protection rules.
