Terms of Use

These Terms of Use (“Terms”) govern your access to and use of SnapGuide (“SnapGuide,” “the App,” “we,” “us,” or “our”), an AI-powered photography guidance application provided by Chengdu Nebula Scroll Technology Co.

By downloading, accessing, purchasing through, or using SnapGuide, you agree to these Terms.

If you do not agree with these Terms, please do not use the App.

1. App Store Terms

If you downloaded SnapGuide through the Apple App Store, your use of SnapGuide is also subject to Apple’s applicable App Store, Apple Media Services, and licensed application terms, including Apple’s Standard Licensed Application End User License Agreement where applicable.

These Terms supplement Apple’s applicable terms.

If these Terms conflict with mandatory Apple requirements or applicable law, Apple’s terms or applicable law will control to the extent required.

Apple is not responsible for providing maintenance or support for SnapGuide except as required under applicable law or Apple’s terms.

2. What SnapGuide Does

SnapGuide allows users to submit reference photographs and use artificial intelligence to convert those photographs into practical photography guidance.

Depending on the feature and AI output, SnapGuide may provide:

• A generated title for a reference photograph;
• Suggested preparation before taking the photograph;
• Step-by-step shooting instructions;
• Suggested camera or phone position;
• Shooting distance or perspective guidance;
• Subject placement and posing suggestions;
• Composition and lighting guidance;
• AI-generated instructional sketches or illustrations;
• A local library for saving generated photography guides.

SnapGuide is designed to help users understand how a photograph might be recreated or approached.

3. AI-Generated Photography Guidance

SnapGuide uses automated artificial intelligence to analyze photographs and generate instructions.

AI-generated information may contain errors, omissions, inaccurate assumptions, inconsistent measurements, or inappropriate suggestions.

Results may vary depending on:

• Image quality;
• Lighting;
• Perspective;
• Device camera characteristics;
• Available shooting space;
• The people or objects involved;
• Environmental conditions;
• AI-model behavior;
• Other factors outside our control.

We do not guarantee that following SnapGuide’s instructions will reproduce a reference photograph exactly or result in any particular photographic outcome.

You are responsible for reviewing AI-generated guidance and deciding whether it is appropriate and safe to follow.

4. Photography and Safety Disclaimer

SnapGuide provides photography guidance only.

You are responsible for evaluating your surroundings before following any instruction.

Do not follow guidance that would require you or another person to:

• Enter restricted, dangerous, or private property without authorization;
• Stand in or near traffic;
• Approach cliffs, water, heights, machinery, wildlife, or other hazards;
• Violate laws or safety restrictions;
• Put yourself or another person at unreasonable risk.

Always prioritize personal safety and applicable laws over any AI-generated instruction.

5. User Photos and Content

You are responsible for photographs and other content you submit to SnapGuide.

You represent and warrant that you have the necessary rights, permissions, or lawful basis to submit and process such content.

You agree not to submit content that:

• Violates applicable law;
• Infringes copyright, trademark, privacy, publicity, or other third-party rights;
• Contains personal or sensitive information that you do not have the right to process;
• Is illegal, abusive, exploitative, or harmful;
• Is submitted for fraudulent or deceptive purposes.

If your photograph contains another identifiable person, you are responsible for obtaining any permission required to use that photograph with SnapGuide.

6. License to Process Submitted Content

You retain your rights in photographs that you submit to SnapGuide.

You grant us and the service providers necessary to operate SnapGuide a limited right to process, transmit, transform, and analyze submitted content solely as reasonably necessary to:

• Provide the requested AI feature;
• Generate photography guidance and instructional images;
• Operate and secure SnapGuide;
• Prevent abuse or fraud;
• Comply with applicable law.

This limited permission does not transfer ownership of your photographs to us.

7. Saved Guides and Local Data

SnapGuide may allow you to save generated photography guides to a local library on your device.

Saved information may include:

• The original reference photograph;
• AI-generated instructional images;
• Guide titles;
• Preparation instructions;
• Shooting instructions;
• Save dates and related identifiers.

You are responsible for maintaining, backing up, and deleting locally stored information.

Removing SnapGuide from your device may permanently remove locally stored guides.

We are not responsible for the loss of local data caused by device loss, device failure, operating-system changes, App deletion, storage corruption, or similar events outside our reasonable control.

8. SnapGuide Pro

SnapGuide may offer premium functionality under SnapGuide Pro.

SnapGuide Pro may provide access to additional or expanded functionality, including AI-powered photography guidance or other premium features made available in the App.

Available premium features may change as SnapGuide evolves.

The exact features included with a purchase are those displayed in the App at the time of purchase, subject to these Terms and applicable law.

9. Purchases and Available Plans

SnapGuide may offer purchase options including:

• Monthly subscriptions;
• Annual subscriptions;
• A lifetime purchase;
• Free trials, introductory offers, or promotional offers where available.

The products and offers available to you may vary by country, App Store account, eligibility, currency, or promotional availability.

The price and billing period applicable to a purchase will be displayed through the App Store before you confirm your purchase.

10. Auto-Renewable Subscriptions

Monthly and annual SnapGuide Pro subscriptions are auto-renewable subscriptions unless otherwise stated at the time of purchase.

When you confirm a subscription purchase:

• Payment is charged to your Apple ID account;
• Your subscription automatically renews unless canceled before the end of the current billing period in accordance with Apple’s rules;
• Apple may charge your account for renewal shortly before the current subscription period ends;
• Renewal pricing will be shown or communicated according to Apple’s applicable requirements.

You can manage or cancel an auto-renewable subscription through your Apple ID or App Store subscription settings.

Deleting SnapGuide does not cancel an active subscription.

11. Free Trials and Introductory Offers

SnapGuide may offer free trials or introductory pricing from time to time.

Eligibility, duration, pricing, and availability are determined by the offer shown through the App Store.

Unless canceled before the trial or promotional period ends in accordance with Apple’s rules, an eligible trial may convert automatically to a paid subscription at the price displayed before purchase.

Apple controls trial eligibility and billing.

12. Lifetime Purchases

Where offered, SnapGuide may provide a one-time lifetime purchase.

A lifetime purchase means access to the features identified as included with that purchase for the commercially supported lifetime of the applicable SnapGuide product, subject to these Terms and applicable law.

A lifetime purchase does not guarantee that:

• SnapGuide will operate forever;
• Every future feature will automatically be included;
• Third-party AI services will remain available indefinitely;
• The App will remain compatible with every future device or operating system.

Nothing in this section limits non-waivable consumer rights under applicable law.

13. RevenueCat

SnapGuide uses RevenueCat to manage products, transactions, purchase restoration, and premium entitlements.

RevenueCat may process Apple purchase or receipt information, product identifiers, anonymous user identifiers, transaction history, entitlement information, and technical information required to provide subscription services.

RevenueCat does not independently determine App Store pricing or charge your payment method. Apple processes App Store payments.

Your use of subscription functionality may also be subject to RevenueCat’s applicable privacy practices and service infrastructure.

14. Purchase Restoration

SnapGuide may provide a Restore Purchases function.

Restoring purchases allows SnapGuide and RevenueCat to check eligible purchases associated with your Apple account and restore applicable premium access.

Successful restoration depends on Apple, RevenueCat, network availability, purchase eligibility, and App Store records.

15. Refunds

Purchases made through the Apple App Store are billed and refunded by Apple.

We do not control Apple’s refund decisions and cannot guarantee that Apple will approve a refund request.

Refund requests should be submitted through Apple’s applicable purchase or support process.

Where applicable law gives you additional refund or cancellation rights, those rights remain unaffected.

16. No SnapGuide Account Required

The current version of SnapGuide does not require a dedicated SnapGuide user account for its core functionality.

Certain features rely on Apple, Firebase, Google, RevenueCat, or other platform services.

You are responsible for maintaining control over your:

• Device;
• Device passcode;
• Apple ID;
• App Store account.

17. Acceptable Use

You agree not to:

• Use SnapGuide for unlawful, fraudulent, abusive, or harmful purposes;
• Upload content that you do not have the right to use;
• Violate another person’s privacy, intellectual property, publicity, or other rights;
• Attempt to bypass purchase, subscription, entitlement, or usage restrictions;
• Circumvent App security or integrity mechanisms;
• Reverse engineer, decompile, disassemble, or modify SnapGuide except where applicable law expressly permits it;
• Interfere with SnapGuide, Firebase, Gemini, RevenueCat, Apple, or related services;
• Use automated systems to overload, scrape, probe, or abuse SnapGuide or its third-party infrastructure;
• Use AI-generated outputs to misrepresent guaranteed photographic results;
• Use SnapGuide in a manner that violates Apple’s rules or applicable law.

18. Third-Party Services

SnapGuide relies on third-party services, including:

• Apple services for distribution, payments, purchases, subscriptions, refunds, and device functionality;
• Google/Firebase and Gemini-related services for AI processing and generation;
• RevenueCat for purchases and premium entitlement management.

These services are operated independently and may experience outages, errors, model changes, pricing changes, service restrictions, or discontinuation.

Your use of third-party services may also be subject to their respective terms and privacy policies.

To the extent permitted by law, we are not responsible for third-party services or events outside our reasonable control.

19. Intellectual Property

Except for content owned by users or third parties, SnapGuide and its software, interface, branding, graphics, design, text, and other proprietary materials are owned by or licensed to Chengdu Nebula Scroll Technology Co. and are protected by applicable intellectual-property laws.

These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to use SnapGuide for its intended purposes.

No ownership rights in SnapGuide are transferred to you.

20. AI-Generated Content

AI-generated instructional text and images are produced automatically.

Due to the nature of generative artificial intelligence:

• Similar or identical output may be generated for different users;
• Output may resemble existing concepts, styles, compositions, or materials;
• We cannot guarantee that generated content is unique;
• We cannot guarantee that generated content is free of every potential third-party claim.

You are responsible for evaluating how you use, publish, distribute, or commercially exploit AI-generated output.

21. Availability and Changes

We may update, modify, replace, suspend, limit, or discontinue parts of SnapGuide where reasonably necessary.

This may include changes to:

• Features;
• AI models;
• AI providers;
• Purchase options;
• Subscription benefits;
• Usage limits;
• User interfaces;
• Device or operating-system requirements;
• Third-party integrations.

Where required by law or Apple’s rules, material changes affecting paid services will be handled in accordance with applicable requirements.

22. No Warranty

SnapGuide is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

We do not guarantee that:

• AI-generated guidance will be accurate;
• A reference photograph can be recreated exactly;
• Generated instructions will achieve a particular result;
• SnapGuide will always be available or uninterrupted;
• SnapGuide will be error-free;
• Third-party services will always remain available;
• All generated information will be appropriate for every shooting environment.

To the maximum extent permitted by law, we disclaim warranties that may otherwise arise by statute, usage, or course of dealing, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

This disclaimer does not exclude warranties or rights that cannot legally be excluded.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Chengdu Nebula Scroll Technology Co. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to SnapGuide.

This may include loss arising from:

• Reliance on inaccurate AI-generated instructions;
• Failed or unsatisfactory photographs;
• Lost local data;
• Third-party service outages;
• Device or network failures;
• Lost profits or business opportunities.

Where applicable law permits a contractual limitation of liability, our total aggregate liability arising from SnapGuide will not exceed the greater of:

• The amount you paid for SnapGuide during the twelve months immediately preceding the event giving rise to the claim; or
• USD $50.

These limitations do not apply where prohibited by applicable law.

24. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer right or statutory protection that cannot legally be waived.

Users in certain countries or regions may have additional rights relating to subscriptions, digital services, refunds, warranties, or unfair contract terms.

Those mandatory rights remain unaffected.

25. Suspension and Termination

We may suspend or restrict access to SnapGuide if we reasonably determine that you:

• Violate these Terms;
• Attempt to circumvent payment or security systems;
• Abuse AI or infrastructure services;
• Engage in fraudulent or unlawful behavior;
• Create a material legal, operational, or security risk.

You may stop using SnapGuide at any time.

Stopping use of SnapGuide or deleting the App does not automatically cancel an App Store subscription.

26. Changes to These Terms

We may update these Terms from time to time as SnapGuide, third-party services, applicable laws, or App Store requirements change.

When we update these Terms, we will revise the Effective Date above.

Where required by applicable law, we will provide additional notice of material changes.

Continued use of SnapGuide after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
