SwimPal Terms of Use

Last Updated: October 28, 2026

These Terms of Use ("Terms") govern your use of the SwimPal application and its related features (the "App"). SwimPal is developed and provided by SwimPal ("we," "us," or "our"). If you have questions about these Terms or the App, contact us at xyhj000@gmail.com.

Please read these Terms before using SwimPal. By using the App, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please stop using the App. A purchase requires separate confirmation through Apple's purchase process. Agreeing to these Terms does not grant access to your Health data; that permission is controlled separately through Apple's authorization system.

1. Apple software license

The license to the SwimPal software downloaded from the App Store is governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms supplement that license by explaining SwimPal's features, subscriptions, and service conditions; they do not replace the Standard EULA. If these Terms conflict with the Standard EULA on software licensing, the Standard EULA controls. Mandatory consumer rights continue to apply.

SwimPal is provided by its developer. Apple does not operate SwimPal or provide its customer support. Your use of Apple services is also subject to the applicable Apple terms.

2. What SwimPal does

SwimPal helps you review swimming workouts already recorded in Apple Health by compatible devices and apps. Depending on the data available and the permissions you grant, features include:

  • Swimming activity summaries and individual workout details, including distance, duration, pace, stroke information, heart rate, active energy, laps, and other available swimming metrics.
  • Trends, comparisons, personal baselines, monthly insights, swimming records, and progress summaries.
  • Locally generated weekly reports and comparisons with the preceding week.
  • A local personal profile, a profile image you choose, distance unit preferences, and a weekly distance goal.

SwimPal currently reads Health data; it does not record new swimming workouts or write to, edit, or delete records in Apple Health. It does not require a separate SwimPal login or online account. The "Account" screen contains your local profile and settings.

Some features are free, while others require an active SwimPal Pro subscription. Pro currently provides access to historical insight months, earlier saved weekly reports, and additional trend periods and history beyond the free viewing limits. Availability depends on the version of the App, available records, and the features described at purchase. A subscription does not create missing Health data or guarantee a particular amount of history. The App currently retains up to 12 weekly report snapshots.

3. Eligibility and responsible use

You must have legal capacity to agree to these Terms. If you are below the age at which you can independently enter into this agreement where you live, a parent or legal guardian must review and agree to these Terms and supervise your use, where such use is permitted by law. Purchases by minors are subject to Apple's purchase controls and any applicable parental authorization requirements.

Use SwimPal lawfully and only with data you are entitled to access. Do not interfere with the App's security, bypass subscription verification, misrepresent purchase entitlements, or infringe another person's rights. These restrictions do not limit activities that applicable law expressly permits.

You are responsible for choosing an appropriate device, protecting access to it, and obtaining any necessary connectivity. Internet access may be required for purchases, restoring purchases, subscription verification, and opening external links. Your carrier or internet provider may charge for that access.

4. Health permissions and data availability

You choose which supported Health data types SwimPal may read. You can decline access or change permissions later using Apple's Health or privacy settings. Features requiring unavailable or unauthorized data may show incomplete information, empty states, or unavailable metrics. You can close the subscription screen and use the free features; purchasing Pro does not require granting Health access.

Results depend on the completeness and accuracy of source workouts, device measurements, pool length settings, timestamps, and other available metadata. SwimPal may calculate estimates or use different methods from other apps, so values may differ. A missing value does not necessarily mean that you did not exercise.

Saved weekly reports are historical snapshots. They may remain visible after you revoke Health access or change or delete the original records in Apple Health, and they may not automatically update to reflect later changes. See the Privacy Policy for storage and deletion details.

5. Fitness information and swimming safety

SwimPal provides general fitness information. It does not provide medical advice, diagnosis, treatment, emergency monitoring, or a personalized clinical assessment. Charts, goals, baselines, and progress indicators are informational and do not establish whether exercise is safe or appropriate for you.

Consult a qualified health professional when you need medical advice or before changing exercise if you have a relevant health concern. Adjust your activity to your ability and the conditions. Follow pool, open water, and equipment safety rules, and use appropriate supervision. Never rely on SwimPal to detect distress, prevent injury or drowning, or summon help. Stop exercising and seek appropriate assistance if you feel unwell or unsafe.

We do not promise improved performance, weight loss, a particular fitness outcome, or uninterrupted availability of every metric. Nothing in this section excludes responsibility or rights that cannot legally be excluded.

6. SwimPal Pro subscriptions

Plans and prices

SwimPal Pro is offered through Apple In-App Purchase as a monthly subscription with a one-month billing period and an annual subscription with a one-year billing period. The purchase screen and Apple's confirmation sheet display the applicable price, currency, period, and any available offer before you confirm.

An annual plan is billed as an annual payment. Any monthly equivalent shown for that plan is a comparison figure, not a monthly installment plan. Prices and availability may vary by storefront. Subscription price changes are handled through Apple's applicable notification and consent procedures.

Payment and renewal

Apple handles payment through your Apple Account. Unless canceled, a subscription automatically renews for the same subscription period. Apple normally attempts renewal during the 24 hours before the current period ends and charges the renewal price applicable to your subscription, subject to Apple's terms and applicable law.

To avoid an unwanted renewal, cancel at least 24 hours before the current period ends. You can manage or cancel a subscription on your iPhone in Settings > your name > Subscriptions > SwimPal, or through Apple's subscription management options. See Apple's cancellation instructions for current guidance and regional differences.

Deleting the App, deleting local data, revoking Health access, or emailing us does not cancel an Apple subscription. We cannot change your Apple Account subscription settings for you.

Free trials and introductory offers

A free trial or introductory offer is available only if Apple makes it available for your chosen plan and confirms your eligibility. No trial is guaranteed. The applicable duration and the price charged afterward are shown before purchase.

Unless you cancel in time, a free trial converts to a paid subscription at the displayed price. Cancel at least 24 hours before the trial ends if you do not want it to renew. Apple determines offer eligibility and the effect of cancellation or switching plans, including whether trial access ends immediately or unused trial time is forfeited. Review Apple's confirmation and subscription screens.

Cancellation, restoration, and refunds

After cancellation, paid access generally continues until the end of the paid subscription period, unless Apple ends it earlier, such as following a refund or revocation. Trial access may end sooner under Apple's rules. If a subscription expires or is revoked, features return to the free access limits; your Apple Health records are unaffected.

You can use Restore Purchases on SwimPal's subscription screen to restore an eligible subscription using the Apple Account associated with that purchase. Restoration depends on verification by Apple. Family Sharing applies only when supported and enabled for the subscription; it is not guaranteed by these Terms.

Apple processes App Store refund requests. You can follow Apple's refund instructions. Eligibility depends on Apple's rules and applicable law. Canceling a subscription does not itself guarantee a refund, and nothing in these Terms removes a refund or other remedy required by law.

7. Your information and privacy

Our Privacy Policy explains the data SwimPal accesses, local processing and storage, Apple services, support communications, retention, and your choices. You can access it from Account > Privacy Policy and from the subscription screen.

Your personal profile, including your nickname, age, gender selection, and selected profile image, is stored locally on your device using SwiftData. App preferences and generated reports are also kept locally. We do not upload this information to a SwimPal server or keep a server copy from which we could restore it. Deletion of local app data is explained in Section 10 and the Privacy Policy.

You retain your rights in your personal information and images. Providing information or selecting a profile image permits only the processing needed to provide the relevant feature, as described in the Privacy Policy; it does not transfer ownership of that information to us. You are responsible for ensuring that you may use any profile image you choose.

The current App has no public profile, social posting, or messaging feature. Selecting a profile image does not publish it to other SwimPal users.

8. Changes, availability, and support

We may update SwimPal to improve it, address security or compatibility issues, or comply with law. Features can depend on Apple's services, device capabilities, operating system versions, and available workout data. Temporary interruptions and errors can occur.

If a material change affects an existing paid subscription, we will provide any notice, continued access, cancellation option, or remedy required by applicable law and Apple's rules. This section does not permit us to remove paid benefits contrary to those obligations.

Contact xyhj000@gmail.com for questions, support, complaints, or claims about SwimPal. Please do not send unnecessary medical records, payment card details, or Apple Account passwords.

9. Warranties and liability

The Standard EULA addresses software warranties and liability. To the extent permitted by applicable law, we do not guarantee that every measurement or calculation will be accurate, that the App will be free of errors, or that it will meet every individual training need.

Nothing in these Terms excludes or limits statutory consumer guarantees or liability that cannot lawfully be excluded or limited, including any applicable liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence. Where a mandatory consumer law gives you a repair, replacement, refund, or other remedy, these Terms do not restrict it.

10. Ending use

You can stop using SwimPal at any time. Using Delete App in iOS permanently removes your personal profile and other local app data from that installation. We retain no server copy and cannot restore deleted local information for you. Offload App preserves documents and data and does not perform this deletion.

Deletion applies to SwimPal's local app storage. It does not erase original Apple Health records, original images in Photos, Apple's purchase records, or copies independently held in device backups. Manage those separately; restoring a device backup or allowing access to Apple Health can make previously available information available again. See the Privacy Policy for details. Deleting the App does not cancel a subscription; cancel it separately if you do not want it to renew.

For a material breach of these Terms, we may take proportionate action available to us under applicable law, including pursuing a legal remedy. Software license termination is governed by the Standard EULA. Any action must respect mandatory consumer rights and applicable Apple requirements.

11. Changes to these Terms

We may revise these Terms and update the date above. Material changes will be brought to your attention through an appropriate notice, such as an in-app notice or release information, before they take effect where required. Where consent is legally required, we will obtain it. Revisions do not retroactively remove accrued rights or remedies.

12. Applicable law and contact

Applicable mandatory law and any rights to use courts or complaint bodies in your place of residence remain available to you. These supplemental Terms do not impose a separate exclusive court, mandatory arbitration requirement, or waiver of collective remedies. The Standard EULA's governing law provisions apply to the software license, subject to mandatory local protections.

If a provision of these Terms is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
